TENZION · Carston Music
Terms of sale, licence & privacy
The fine print, kept as plain as we can.
1 Who we are
TENZION is made and sold by Carston Music (eenmanszaak), based in Rosmalen, the Netherlands.
- Business address
- Heer en Beekstraat 19B, 5242 AC Rosmalen, the Netherlands
- Chamber of Commerce (KvK)
- 84302453
- VAT number
- NL003943606B16
- info@carstonmusic.com
In these terms, “we” and “us” mean Carston Music, and “you” means the person buying or using TENZION.
2 What these terms cover
These terms apply to every purchase of TENZION (“the software”) through shop.carstonmusic.com and to your use of it. They combine our terms of sale and the end-user licence agreement (EULA).
When you buy TENZION you buy a licence to use the software, not the software itself. By accepting these terms at checkout and completing your purchase, you accept them.
3 Prices and payment
- Prices are shown in euros and include VAT where applicable. The amount you pay is the amount shown at checkout. The price includes 21% Dutch VAT. If our sales to consumers in other EU countries ever pass the EU threshold, we charge the VAT rate of your country instead, through the EU One-Stop Shop (OSS).
- Payments are processed by Stripe. We never see or store your full card details.
- Your purchase is complete once the payment has been confirmed. Stripe emails your receipt and invoice; your licence code and the download link are shown on screen right after payment and sent to you in a separate email from us (see section 4).
4 Delivery
TENZION is digital content and is delivered immediately. As soon as your payment is confirmed, your personal licence code and the download link are shown on the page you return to after checkout, and emailed to the email address you used at checkout. The email usually arrives within minutes.
If something goes wrong on our side, we send them by email as soon as we can and at the latest within 24 hours of your payment. Didn’t receive them? Check your spam folder first, then contact us at info@carstonmusic.com.
5 Right of withdrawal
Consumers in the EU normally have 14 days to withdraw from an online purchase. For digital content that is not on a physical medium, this right ends once delivery has started, if you agreed to immediate delivery and acknowledged that you lose your right of withdrawal.
Before you go to checkout you tick a box confirming that you want delivery to start within the 14-day withdrawal period and that you understand you lose your right of withdrawal once we have sent you your licence code and download link. Delivery starts immediately after your payment is confirmed, when your licence code is first shown on screen or emailed to you, whichever comes first. From that moment your right of withdrawal ends. If delivery has not started yet, you can still withdraw: email us (you may use the EU model withdrawal form, but a short email is enough) and we refund the full amount within 14 days, using the same payment method. We confirm your consent in the email with your licence code.
6 Refunds and your legal rights
If TENZION doesn’t work on your Mac as described and we can’t fix it, you get a full refund: email us within 30 days of your purchase. Otherwise we don’t give refunds once your licence code has been delivered, because digital content can’t be returned.
Whatever our refund policy says, your statutory rights stay intact: TENZION must work as described on our product page. If it doesn’t and we can’t fix it within a reasonable time, you are entitled to a remedy under the law of your country, such as a price reduction or a refund.
7 Your licence
When your payment is confirmed, we give you a personal, non-exclusive, non-transferable licence to:
- install and use TENZION on computers that you own or control yourself, on as many of your own computers as you like (there is no activation limit);
- use it for personal and commercial music production, including your releases, live sets and client work.
The music you make with TENZION is yours. You can use audio that you processed or generated with it (such as the snare roll, riser and drop sounds inside your tracks) in your own productions, without paying royalties.
The licence stays valid unless it ends under section 8. It does not expire.
8 What you may not do
- Share, publish, upload or otherwise distribute TENZION, its installer or your licence code.
- Sell, rent, lend, sublicense or transfer your licence to someone else.
- Get around, disable or tamper with the licence check.
- Reverse engineer, decompile or modify the software, except where the law explicitly allows it.
- Extract the built-in sounds and distribute them on their own, for example as a sample pack or sound library.
If you break these rules, your licence ends automatically and you must stop using and delete TENZION.
9 Your licence code
Your licence code is linked to the email address you used at checkout. You activate TENZION once by entering that email and the code; the check happens on your own computer and works offline.
Keep your code private. A code that was obtained through fraud, or for a payment that was reversed or charged back, is not a valid licence. Lost your code? Email us from the address you bought with and we’ll send it again. Need it on a different email address? Ask us and we’ll make a new code for that address.
10 Updates and support
Updates within TENZION version 1 are free. If there is ever a new major version (TENZION 2), it may be a paid upgrade; your version 1 licence keeps working.
Support is by email at info@carstonmusic.com. TENZION runs on macOS (AU and VST3). Please check the requirements on the product page before buying.
11 Warranty and liability
We put a lot of love into TENZION, but software is never perfect. Apart from your statutory rights (section 6), TENZION is provided “as is”, without any further guarantees, for example that it works with every computer, DAW or other plugin.
As far as the law allows, our total liability is limited to the amount you paid for your licence, and we are not liable for indirect damage such as lost data, lost projects, lost income or missed deadlines. Please keep backups of your projects. None of this limits liability that cannot be limited by law, such as liability for intent or gross negligence, or your mandatory rights as a consumer.
12 Ownership
TENZION, its code, design, sounds and the names TENZION and Carston Music belong to Carston Music. Your licence gives you the right to use the software as described here; it doesn’t transfer any ownership.
TENZION includes third-party components, used under their own licences: the JUCE framework (JUCE licence), the Steinberg VST3 SDK (MIT licence), the Apple AudioUnitSDK (Apache License 2.0), and the fonts Marcellus, Manrope and Cormorant Garamond (SIL Open Font License 1.1). VST is a registered trademark of Steinberg Media Technologies GmbH.
13 Governing law and disputes
These terms are governed by Dutch law. If you are a consumer living outside the Netherlands, you keep the protection of the mandatory consumer laws of your own country.
Something wrong? Email us first; we’d love to solve it together. If we can’t, disputes go to the competent court in ’s-Hertogenbosch, the Netherlands, unless the law gives you the right to go to a court where you live.
14 Changes to these terms
We may update these terms. The version that applies to your purchase is the one you accepted at checkout. Changes never take away rights you already have for a licence you bought.
15 Privacy
We keep this short because we collect very little. Carston Music is responsible (the “controller”) for the personal data described here.
What the store processes
- Your email address: to deliver your licence code and download link, to link your licence code to you, and to help you with support.
- Payment details: handled by Stripe, which processes your payment. We receive the payment status, amount, currency and country (for VAT), not your full card details. Stripe’s own privacy policy also applies.
- Your licence code and order details: the licence code, a licence number, the Stripe order reference and the date, so we can deliver and resend your licence, answer questions and prevent fraud. The shop stores this licence record (with your email address) in a database at Cloudflare.
- Emails you send us: when you contact support.
Why we may use it
To perform our agreement with you (delivering and supporting your licence), to meet our legal obligations (such as tax records), and our legitimate interest in preventing fraud. We don’t sell your data and we don’t send marketing without your permission.
No tracking in the plugin
TENZION has no tracking or analytics. Your licence is checked on your own computer, offline.
Who else sees it
- Stripe (payments)
- Resend (sends the licence email automatically; it receives your email address and the content of that email)
- Cloudflare (hosting this shop website and storing your licence record: your email address, licence code and Stripe order reference; also processes technical data such as IP addresses)
- Google (Google Workspace: our mailbox, for support and for any licence email we send by hand)
- Anthropic (Claude, the AI assistant we use when we make a licence code and email by hand, for example a replacement; it sees your email address)
- Google Fonts (the fonts on this website; your browser loads them from Google, which receives your IP address)
Some of these providers may process data outside the EU, with appropriate safeguards in place. For transfers to the United States they rely on the EU–US Data Privacy Framework or the EU’s standard contractual clauses.
How long we keep it
Order and licence records: 7 years, as Dutch tax law requires. Support emails: up to 2 years after our last contact.
Your rights
You can ask to see, correct or delete your data, to receive a copy, or object to how we use it. Email info@carstonmusic.com. You can also complain to the Dutch data protection authority, the Autoriteit Persoonsgegevens, or the authority in your own country.
This shop website sets no cookies of its own. Stripe’s checkout page may use cookies to process your payment and prevent fraud.
